Representative Matters

Represented an international oil and gas producer in a suit to establish primacy of oil and gas lease of mineral servitude owner in Haynesville Shale play against competing lease from surface owners. In late 2012 the State of Louisiana attempted to intervene in the matter seeking to overturn a prior ruling of the Louisiana Supreme Court in 1922 declaring Dolet Bayou non-navigable. We successfully defeated the intervention and preserved the nearly century old precedent against the State’s attack. The State has now appealed the dismissal of the intervention to the Court of Appeals.

 

Represented co-executor of a Succession suit to terminate oil and gas lease for lapse of production, for damages for non-payment of royalties and for double royalties, interest, costs and attorneys’ fees. The Court entered judgment in favor of the executors for unpaid royalties plus an award of damages equal to the amount of royalties for a total award in excess of $3.6 million, including an additional award of attorneys’ fees in excess of $500,000. An appeal is pending.

 

Motion for Reconsideration granted by district court and upheld by United States Fifth Circuit Court of Appeals in Alyce Gaines Johnson v. El Paso, confirming granting clause in standard Bath Form as broad and unambiguous.

 

Defending an independent oil and gas company and certain related individuals against contrary claims of property and mineral ownership in United States District Court as raised by the United States of America and mineral lessees thereof. The dispute involved conflicting interpretations as to the factual and legal status of certain lands currently covered by a freshwater lake.

 

Defending a publicly traded oil and gas company and its joint venture partner in a putative class action lawsuit whereby individuals claim to have been damaged and adversely affected by circumstances related to drilling activities, including allegations of water, soil, and air contamination affecting more than 100 individuals and nearby property.

 

Defending a publicly traded oil and gas company against individuals claiming ownership of mineral rights based on failure of title and violation of due process rights in connection with prior tax sale.

 

Small Engine Shop, Inc. v. Cascio, a seminal case cited for establishing the due process standard in Louisiana following the Mennonite case and holding that the Louisiana statute providing the owner of a property interest to file a request for notice of seizure did not shift the entire burden for notice to the property owner.

 

Defending a publicly traded oil and gas company against individuals claiming past due royalties and damages of double the amount of royalties due and lease cancellation under the Louisiana Mineral Code. The case was tried in U. S. District Court, Western District of Louisiana, resulting in a jury verdict in favor of client, awarding no damages or lease cancellation.
